Terms of Service

1. Master Service Agreement

These Terms of Deployment constitute a legally binding agreement between you (the "Client") and Quantum Kenya. By accessing our platform, compiling our modules, or utilizing our Multi-Vendor ERP, you agree to be bound unconditionally by these terms. If you do not accept these parameters, you must sever your connection to our servers immediately.

2. Intellectual Property & Copyright Sovereignty

All source code, UI/UX aesthetics, database schema topographies, compiled binaries, and algorithmic logic underlying the Quantum ecosystem remain the exclusive intellectual property of Quantum Kenya. Purchasing a "Node" or custom software deployment grants you a revocable, non-exclusive deployment license, strictly prohibiting reverse-engineering, module scraping, or un-licensed replication.

3. Acceptable Use Policy

You agree to utilize our Bulk SMS API and ERP modules specifically for lawful enterprise operations. The utilization of our network infrastructure to transmit unsolicited promotional anomalies (SPAM), malicious payloads, or content violating Kenyan or international cyber-law will result in immediate API termination and forensic reporting to necessary authorities.

4. Service Level & Uptime Constraints

While our architects deploy redundant monolithic nodes to ensure 99.9% uptime, Quantum Kenya cannot be held liable for latency drops or total server loss resulting from catastrophic infrastructure failures outside our data centers, ISP blackouts, or Acts of God. Financial compensation is limited to the prorated cost of the disruption window.

5. Financial Operations & Taxation

All bespoke developments, node acquisitions, and API credits require clear funds before deployment. Where stated, 16% Value Added Tax (VAT) applies seamlessly to invoices conforming to KRA specifications. Subscriptions are automatically deducted unless a shutdown command is issued 14 days prior to the billing cycle.
